H1-B Visa


The H-1B visa is a non-immigrant visa, which gives the foreign workers in “specially occupations” and fashion models of “distinguished merit and ability” the opportunity to work in the United States. The “specially occupations” are applicants with highly specialized knowledge as well as at least accomplishment of bachelor’s degree. The alien must demonstrate his/her qualification to perform the task. Also, the applicant must take any state or federal exams, which are required in order to practice in the United States. Foreign medical graduates must meet additional requirements to be eligible for H-1B visa. Regarding the fashion model, national and international recognition as well as outstanding achievement are vital. Moreover, recognition for significant achievement from fashion houses, modeling agencies, or organizations in addition to evidence of high salary is required.
The workers are considered as permanent residences in this category as long as they leave the United States at the end of their authorized period of stay. Spouse and unmarried children under age of 21 of the applicant can accompany him/her under H-4 status. They can engage in studies, but they are not permitted to work under this status. When the qualification is based on working in a specialty occupation, the applicant must have the credentials normally possessed by a person qualified in a specially occupation. The Service decides whether the alien possesses the essential documentations to be eligible to practice.
